Terms of Service

1. Acceptance of Terms

By accessing or using AskGTO ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

AskGTO is an AI-powered poker coaching platform that provides Game Theory Optimal (GTO) strategy analysis and recommendations for Texas Hold'em poker. The Service accepts text, voice, and image inputs to analyze poker hands and provide strategic advice through a conversational interface.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old to create an account.

4. Subscription Plans and Payments

4.1 Plans

The Service offers both free and paid subscription plans. Free accounts are subject to daily usage limits. Paid plans provide increased usage allowances and additional features as described on our pricing page.

4.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually) through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on each billing cycle. All prices are listed in the currency displayed at checkout.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are provided for unused time within a billing cycle.

4.4 Refunds

Refund requests are evaluated on a case-by-case basis. If you are unsatisfied with the Service, please contact us at support@askgto.com within 7 days of your initial purchase. We reserve the right to approve or deny refund requests at our discretion.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools (bots, scrapers) to access the Service without prior written consent
  • Resell, redistribute, or commercially exploit the Service or its output without authorization
  • Share your account credentials with third parties
  • Use the Service to facilitate real-money gambling operations

6. Intellectual Property

The Service, including its design, code, algorithms, content, and branding, is the intellectual property of AskGTO and is protected by applicable intellectual property laws. You retain ownership of the input data you submit (hand histories, questions), but grant us a license to process this data to provide the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. The poker analysis and strategy recommendations provided by the Service are generated by AI models and should be used for educational and informational purposes only. We do not guarantee the accuracy or profitability of any recommendations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AskGTO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Poker and Gambling Disclaimer

AskGTO is an educational tool for studying poker strategy. The Service does not facilitate, promote, or endorse real-money gambling. Strategy recommendations are based on game-theoretic analysis and are not guarantees of winning outcomes. Users are solely responsible for their own decisions at the poker table and for complying with local gambling laws.

10. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. You may also delete your own account at any time through your account settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AskGTO operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
